On July 17, 2026, the Honorable William H. Orrick of the United States District Court for the Northern District of California issued an Order resolving motions filed by Plaintiff. The Order represents a strong result on behalf of  SLB’s client.

Key Rulings in the Order

Motion for Leave to File Second Supplemental Complaint — DENIED

Plaintiff sought to add a new First Amendment retaliation claim based on a 2025 Interim Assessment Report made by the client. The Court acknowledged that supplemental pleadings are generally favored under Rule 15(d), but denied leave, as requested by SLB defense attorney Eric Martinez, because Plaintiff had prior opportunities to address the report and amendment would cause undue delay to HOPE and require extension of discovery deadlines.

Strategic Significance

This Order is a significant win for Sims, Lawrence & Broghammer’s client.

By denying the motion for leave to file the supplemental complaint, the Court prevented the addition of a new retaliation claim that would have been difficult to dismiss on the pleadings and could have delayed resolution of the case.

The denial of the TRO also clears the way for the state-court process regarding the juvenile records to proceed.
