The Facts
Attorney Lawrence argued that Plaintiffs’ Negligence claims failed due to the Assumption of the Risk Defense because Plaintiffs signed a disclaimer and hold harmless agreement and that causation could not be established. Additionally, SLB client could not be liable for Battery because there was no evidence that the home healthcare worker was infected with COVID-19 and had not touched Plaintiffs unlawfully.
The Verdict
After oral argument the Court granted the MSJ in its entirety.
