Motion for Summary Judgment Victory Involving COVID-19 Allegations
Sims, Lawrence & Broghammer’s Meghan Lawrence won her Motion for Summary Judgement in a unique case involving allegations that a home healthcare worker spread COVID-19 to Plaintiffs resulting in hospitalization and severe health complications.

Meghan Lawrence
Attorney at Law

The Facts
Attorney Lawrence argued that Plaintiffs’ Negligence claims failed due to the Assumption of the Risk Defense because Plaintiffs signed a disclaimer and hold harmless agreement and that causation could not be established. Additionally, SLB client could not be liable for Battery because there was no evidence that the home healthcare worker was infected with COVID-19 and had not touched Plaintiffs unlawfully.
The Verdict
After oral argument the Court granted the MSJ in its entirety.
