In yet another AAA Arbitration, Bob Sims obtained an Award in AAA Arbitration on a single family home located in Truckee.

The Facts
Plaintiffs claimed damage to two homes from drainage problems including a flood event that damaged the finished basement of the home. There were other assorted construction defects alleged. Claimant alleged 51,313,029 in damages. Bob defended claiming that the drainage system was installed according to plans and the system was overwhelmed by rains in excess of the plans criteria.
Settlement Discussions
Plaintiff’s lowest demand was $600,000. CCP § 998s were issued totaling $925,000. An offer of $150,000 was made to Claimant for all their damages.
The Verdict
In July of 2018, in response to the SI.3 million claim, an Award was issued for a total of $73,338.40. In addition, the Award made Bob ’s client the prevailing party’ on a 80%/20% basis (80% to our client). Attorney fees and cost motions are outstanding.
